These Terms of Service (“Terms”) govern your access to and use of the Lingwu AI interview platform and related services. By registering or using the Service, you agree to these Terms.

1. The Service

Lingwu provides tools to create, conduct, and analyze AI-assisted interviews, including voice and chat modes, reporting, and team collaboration.

We may modify, suspend, or discontinue features with reasonable notice where practicable.

2. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account.

You must be at least 16 years old and have authority to bind your organization if you register on its behalf.

We may suspend or terminate accounts that violate these Terms or pose security risks.

3. Acceptable Use

You agree not to misuse the Service, including: violating laws; infringing others’ rights; uploading malware; attempting unauthorized access; or using the Service to discriminate unlawfully in hiring decisions.

You are responsible for obtaining lawful consent from interview participants and for providing required notices about recording, AI processing, and data use.

4. Customer Content

You retain ownership of content you submit (questions, interviews, recordings, etc.). You grant us a limited license to host, process, and display it solely to provide the Service.

You represent that you have the rights necessary to submit content and to authorize our processing.

5. AI Outputs

AI-generated summaries, scores, and suggestions are assistive only and may be inaccurate or incomplete. You are responsible for human review and final hiring or evaluation decisions.

We do not guarantee outcomes of interviews or compliance with employment laws in your jurisdiction.

6. Paid Plans

Enterprise and usage-based fees (including annual packages and per-interview overage) are as quoted on our website or in your order. Taxes may apply.

Unless otherwise agreed, fees are non-refundable except where required by law. We may change pricing with notice for renewals.

7. Third-Party Services

The Service may integrate third-party AI, voice, authentication, or hosting providers. Your use of those services may be subject to their terms. We are not responsible for third-party services outside our reasonable control.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100) IF NO FEES WERE PAID.

10. Termination

You may stop using the Service at any time. We may terminate or suspend access for breach of these Terms or for operational reasons with notice where reasonable.

Upon termination, your right to use the Service ceases; provisions that by nature should survive (e.g., liability limits, content licenses for backup retention) will survive.

11. Governing Law and Disputes

These Terms are governed by the laws of the People’s Republic of China, excluding conflict-of-law rules, unless mandatory local law requires otherwise.

Disputes shall first be resolved through good-faith negotiation; failing that, submitted to the courts with jurisdiction where our principal place of business is located.

We may update these Terms by posting a revised version on this page. Continued use after changes constitutes acceptance where permitted by law.
